Error trying to update theme

Hello,
I am having an issue with just one of my installations when trying to update the theme from virtue 3.6.5.
The error I am receiving is:
An error occurred while updating Virtue – Premium: Could not copy file. virtue_premium/assets/js/plugins.js
This is only happing on one install going via the wordpress update in the dashboard.
